Acceptance
These Terms are the agreement between you and Southern East Inc. for BIM Tools Hub. You agree to them when you sign in, submit a tool, pay for Fast Track, or otherwise use BIM Tools Hub. If you don't agree, don't use the site.
Our Privacy Policy explains how we handle personal information. It is part of how the site works. If these Terms and the Privacy Policy both speak about your information, the Privacy Policy describes the privacy rules.
Who we are
BIM Tools Hub is run by Southern East Inc., a corporation incorporated under the laws of Canada, at 222 Main St E, North Bay, ON P1B 1B1, Canada. In these Terms, "we" and "us" mean Southern East Inc..
The service
BIM Tools Hub is a directory of Building Information Modeling tools and software. It helps professionals compare tools. We don't make those tools. A listing can include a name, description, logo, and screenshots that belong to the tool's maker.
Accounts
You can sign in with Google or GitHub. You're responsible for activity on your account. You can ask us to delete your account. We delete account and saved-tool data within 30 days, except records we're required to keep, such as payment records. The Privacy Policy says how long we keep each kind of record.
Your content
You own it
"Your Content" means everything you submit, upload, or create on BIM Tools Hub, such as tool submissions, descriptions, logos, and screenshots you provide. You keep all your rights in it.
The license you give us
You give Southern East Inc. a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, adapt for formatting and display, and display Your Content. We may do this only to:
- provide, secure, maintain, and support BIM Tools Hub for you, including showing Your Content where you direct;
- show content you choose to make public on BIM Tools Hub, and in listings or search results that promote BIM Tools Hub;
- improve and develop our services, including analyzing how they're used and, only where our Privacy Policy says so, training and testing models used for features of BIM Tools Hub; Starts
- create statistics and anonymized information as described in our Privacy Policy. Starts
Limits
We won't sell Your Content. We won't give it to a third party for that party's own purposes, including training the third party's AI models, unless you opt in or tell us to. Our service providers may handle it only to help us run BIM Tools Hub.
How long the license lasts
It ends when you delete Your Content or your account, or ask us to remove a listing. Exceptions:
- statistics and anonymized information already created; Starts
- backup copies, until they're overwritten in our normal cycle, within 35 days;
- anything you've already shared with others or published; and
- anything the law requires us to keep.
You represent that:
- All information you provide is accurate and complete
- You have the right to submit the information
- The submission doesn't violate any third-party rights
Submissions and Fast Track
You can submit a tool for free while signed in, or pay for Fast Track review. Card details for Fast Track go straight to Stripe. We can decline a submission that doesn't meet our listing standards. How soon we review a submission depends on the review team's capacity.
Fast Track payments are non-refundable once your listing has been reviewed or published, except where the law requires a refund. If you've paid for a Fast Track submission that we haven't reviewed yet, and you don't agree with a material change to these Terms, we'll refund it if you ask. That right is also in Changes to these Terms.
Service Data Starts
"Service Data" means (a) statistics and anonymized information we create as described in our Privacy Policy, and (b) technical and usage information about how BIM Tools Hub performs, such as uptime, errors, and feature usage. Service Data does not include Your Content itself, and it does not identify you, your business, or any other person.
We own Service Data. We may use, publish and license it for any lawful purpose, but only while it stays non-identifying, and only if each recipient agrees in writing not to re-identify anyone, not to combine it with other data to do that, and not to pass it on without the same terms. If Service Data turns out to identify someone, we'll treat it as personal information under our Privacy Policy and fix the problem.
Intellectual property
BIM Tools Hub's own writing, the site design, and the way the directory is organized belong to Southern East Inc. or our licensors.
Tool names, logos, and screenshots belong to their makers. We host copies so we can show a listing. Ownership stays with the maker.
Your Content belongs to you. The license in Your content is the only right you give us in it.
Acceptable use
- Don't scrape BIM Tools Hub in a way that slows it down, breaks it, or skips technical limits.
- Don't submit a listing that is false, misleading, or infringing.
- Don't try to break into an account, or interfere with the service.
- Don't use the site to harm another person.
Disclaimers
Listings are for information. They aren't professional advice, and they aren't an offer from the tool maker. We try to keep listings useful, and they can still be incomplete or out of date. The tools themselves are provided by their makers, under those makers' terms.
Limitation of liability
To the extent permitted by law, Southern East Inc. is not liable for indirect, incidental, special, or consequential damages, or for lost profits, arising from your use of BIM Tools Hub.
This limit doesn't apply where the law doesn't allow it. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that the law says we can't exclude or limit.
BIM Tools Hub is provided as it is. We don't promise that it will be uninterrupted or error-free.
Assignment Starts
We may assign or transfer these Terms, and our related rights and obligations, including information handled under our Privacy Policy. We may do this to an affiliate, or to a successor in a merger, acquisition, financing, reorganization, insolvency, or sale of all or part of our assets or of the business of BIM Tools Hub. The successor must honour these Terms and our Privacy Policy for the information it receives, unless it gives you notice and gets any consent required under Changes to these Terms and our Privacy Policy. We'll tell you within 30 days after such a transfer. You may not assign these Terms without our written consent.
Governing law Starts
These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there. This doesn't take away any consumer-protection rights you have where you live.
Changes to these Terms
What counts as material
A change is material if a reasonable user would consider it significant. For example, it reduces your rights or our obligations, raises fees, changes how we use or share your data, changes dispute resolution or governing law, or takes away a paid feature.
Notice
We'll give at least 30 days' notice of a material change, by email and with a notice on BIM Tools Hub. The notice will summarize the change and link to the old and new versions.
Your data
A change that expands how we use or share data applies to data we collected before the change only if you expressly agree.
Your options
If you don't agree, you can stop using BIM Tools Hub and close your account before the change takes effect. If you've paid for a Fast Track submission that we haven't reviewed yet, we'll refund it if you ask.
Other changes
Non-material changes take effect when we post them. Except as the "Your data" paragraph says, using BIM Tools Hub after a change takes effect means you accept the updated Terms.
Past versions are listed in Past versions. If the law requires a change sooner, we'll give as much notice as we can.
